1. Introduction and Scope
This JobBidders Privacy Policy ("Policy") describes how this Platform ("we," "us," or "our") collects, uses, discloses, shares, stores, transfers, retains, deletes and protects your personal information when you access or use our Platform, including all websites, mobile applications, and related services (collectively, the "Platform"). This Policy is incorporated by reference into our Terms of Service.
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to this Privacy Policy. If you do not agree, please do not use the Platform.
YOUR CONTINUED USE OF THE PLATFORM AFTER ANY CHANGES TO THIS POLICY CONSTITUTES YOUR ACCEPTANCE OF THOSE CHANGES.
This Policy applies to all Users, including Customers and Contractors, and covers all information collected through the Platform, including information collected when you create an account, use our services, communicate with other Users or us, interact with our websites or mobile applications, use third party login services, or otherwise interact with the Platform, in electronic messages between you and the Platform, or through any other means.
2. Information We Collect
2.1. Information You Provide Directly:
- Account registration data (name, email address, phone number, home/business address, and other account authentication information)
- Profile information (biography, skills, service categories, profile photo, portfolio photos and videos, and other information you choose to include in your profile)
- Payment and billing information (processed and stored by third-party payment processors; we do not store full card numbers or other sensitive payment credentials)
- Job postings, bids, bookings, and service requests
- Messages and communications with other Users or with us, including photographs, videos, documents, attachments, and other User-generated content
- Professional documents (licenses, insurance certificates, certifications, and other business or professional credentials)
- Government-issued identification submitted for identity verification and other information required for identity verification or legal compliance
- Background check information submitted via third-party providers
- Reviews, ratings, and feedback
- Responses to surveys, promotions, or contests
- Any other information you choose to provide
2.2. Information Collected Automatically:
- Device information (device type, operating system, browser type and version, hardware model, unique device identifiers, internet service provider, device settings, and similar technical information)
- Log data (IP address, access times, pages viewed, referring URLs, search queries, and other system activity information)
- Usage data (features used, interactions, time spent on pages, clicks, and other behavioral data)
- Location data (precise or approximate geolocation, if permitted by your device settings)
- Cookies and similar tracking technologies (see Section 10), including other technologies used to recognize your device and improve the Platform
- Transaction history and activity on the Platform
- Metadata and technical information associated with content uploaded to or generated through the Platform.
2.3. Information from Third Parties:
- Background check results from third-party screening providers
- Identity verification data from verification service providers
- Payment processing information from payment processors
- Information from social media platforms if you link or log in through them
- Publicly available information such as professional licenses or public records
- Information from business credit reporting agencies
- Referral information if another User referred you to the Platform
- Information from third party service providers, business partners, analytics providers, advertising partners, fraud prevention providers, authentication providers, and other third parties that support the operation of the Platform.
2.4. Data Processor / Business Customer Relationship
In certain circumstances, we process personal information on behalf of Contractors, business customers, or other users who use the Platform to manage their own customers, employees, or business operations. In such cases, we act as a service provider or data processor, and the applicable Contractor or business customer remains responsible for determining how personal information is collected, used, and disclosed. If you are an end customer of one of our Contractors or business customers and wish to exercise your privacy rights regarding information processed on their behalf, you should contact the applicable Contractor or business customer directly. Where required by applicable law, we will reasonably assist them in responding to your request.
3. How We Use Your Information
We use collected information for the following purposes:
- Providing, operating, maintaining, and improving the Platform and our services
- Creating and managing your account and verifying your identity
- Facilitating connections between Customers and Contractors
- Facilitating payment processing where payment functionality is offered through the Platform.
- Sending transactional communications (receipts, booking confirmations, service updates)
- Sending marketing, promotional, and informational communications (with your consent where required)
- Conducting background checks, identity verifications, and fraud prevention
- Enforcing our Terms of Service and other policies
- Investigating and resolving disputes between Users
- Responding to your inquiries and providing customer support
- Complying with applicable laws, regulations, legal process, and government requests
- Protecting the rights, property, and safety of the Platform, our Users, and the public
- Personalizing your experience and delivering targeted content or advertising
- Conducting internal analytics, research, and service improvement
- Monitoring, detecting, preventing, and investigating fraudulent, unauthorized, illegal, or harmful activities and maintaining the security and integrity of the Platform
- Verifying compliance with our policies, legal obligations, and eligibility requirements
- Operating, administering, troubleshooting, testing, developing, and enhancing the Platform and its features
- Providing AI-powered features, automated recommendations, content moderation, pricing guidance, and other functionality offered through the Platform
- Creating aggregated, anonymized, or de-identified data for analytics, research, business intelligence, and service improvement, where permitted by applicable law
- Facilitating business transactions, mergers, acquisitions, financing, reorganizations, or similar corporate events
- Performing any other purpose described to you at the time of collection or otherwise permitted or required by applicable law.
4. Sharing and Disclosure of Your Information
We may share your information in the following circumstances:
- Between Users: When you engage in a transaction, we share relevant information (such as name, contact details, and profile) with the other party to facilitate the service. In-app messages are available after a contractor submits a bid on a job (not cold outreach). Phone numbers and exact street addresses, when provided, are shared only after a bid is accepted.
- Service Providers: With trusted third-party vendors who assist us in operating the Platform, including payment processors, background check providers, identity verification services, cloud hosting providers, analytics tools, email service providers, and customer support tools. These vendors are bound by confidentiality obligations and may only use your information as directed by us.
- AI Service Providers: We may share personal information with trusted artificial intelligence and machine learning service providers solely for the purpose of providing AI-powered features requested by you, such as job description generation, photo analysis, pricing guidance, bid writing assistance, content moderation, fraud detection, and other Platform functionality. These providers are contractually required to protect your information, maintain its confidentiality, implement appropriate security measures, and process personal information only on our documented instructions and in accordance with applicable law.
- Legal Requirements: When we believe disclosure is required or permitted by law, regulation, legal process, or governmental request; or to enforce our Terms; or to protect our rights, property, or safety or that of our Users
- Business Transfers: In connection with or during negotiations of any merger, acquisition, asset sale, financing, or reorganization involving the Platform. Your information may be transferred as a business asset
- Safety and Security: To protect against fraud, abuse, harassment, or other harmful activity on the Platform, including sharing with law enforcement when appropriate
- Affiliates: With our parent companies, subsidiaries, and affiliated entities, subject to this Privacy Policy
- Professional Advisors: With our attorneys, accountants, auditors, insurers, consultants, and other professional advisors where reasonably necessary for legal, business, compliance, or operational purposes.
- Business Partners: With business partners, integration partners, and third parties that help provide features, services, promotions, or functionality you request through the Platform.
- With Your Consent: For any other purpose with your explicit consent
- Aggregated or De-identified Data: We may share aggregated or de-identified information that cannot reasonably be used to identify you
- To Establish, Exercise, or Defend Legal Claims: Where necessary to establish, exercise, or defend legal rights, investigate claims, resolve disputes, collect amounts owed, or enforce our agreements.
We do not sell your personal information to third parties for their own marketing purposes.
However, we may share personal information for purposes such as analytics, advertising, or business operations as described in this Privacy Policy and as permitted by applicable law.
5. Background Checks and Identity Verification
We use third-party background check and identity verification providers. By using the Platform, you authorize us and our providers to obtain, verify, collect, process, and share background checks, identity verifications, professional license verifications, business credential verifications, and business credit checks on you, as permitted by applicable law including the Fair Credit Reporting Act ("FCRA") and other applicable federal, state, and local laws. Background check information is handled in compliance with applicable law and the privacy policies of the relevant third-party providers.
Contractors may also choose to upload business licenses, insurance certificates, driver's licenses, certifications, and other professional credentials to their profiles. If a Contractor elects to use JobBidders' optional third-party verification services, JobBidders may collect, process, and share the information necessary to facilitate that verification with its independent verification providers. Information received from such providers may be used to display a "JobBidders Verified" designation on the Contractor's profile, where applicable.
You acknowledge that the scope, frequency, and type of background checks or identity verification may vary depending on your role on the Platform, the services you provide or request, applicable legal requirements, risk assessments, or our internal policies.
We may use the results of background checks and identity verification to verify your identity, determine your eligibility to use certain Platform features, prevent fraud, enhance Platform security, comply with legal obligations, and enforce our Terms of Service and other policies.
If adverse action is taken based on background check results, you will be notified as required by law and provided with information about your rights.
We do not guarantee the accuracy, completeness, or reliability of any background check or identity verification performed by a third-party provider, and such checks should not be considered a guarantee of a user’s identity, qualifications, trustworthiness, or future conduct.
6. Data Security
We implement commercially reasonable technical, administrative, and physical security measures designed to protect your personal information from unauthorized access, use, alteration, or destruction. These measures include encryption, access controls, secure servers, and regular security assessments, network monitoring, authentication measures, data backup procedures, employee access restrictions, and other industry standard safeguards appropriate to the nature of the information we process.
We also require, where appropriate, that our third-party service providers implement reasonable administrative, technical, and physical safeguards designed to protect the personal information they process on our behalf.
HOWEVER, NO METHOD OF TRANSMISSION OVER THE INTERNET OR ELECTRONIC STORAGE IS 100% SECURE. WE CANNOT GUARANTEE ABSOLUTE SECURITY OF YOUR DATA.
You use the Platform and transmit information at your own risk. You are responsible for maintaining the secrecy of your account credentials. Please notify us immediately of any suspected unauthorized access to your account.
In the event of a security incident or data breach involving your personal information, we may notify affected individuals, regulators, or other authorities as required by applicable law.
To help protect our Platform and Users, we may monitor account activity for suspicious or unauthorized access, compromised credentials, unusual login patterns, fraudulent activity, or other security risks. Where appropriate, we may require password resets, temporarily suspend or restrict account access, request additional identity verification, or take other reasonable measures to protect user accounts and Platform security.
7. Data Retention
We retain your personal information for as long as your account is active, as needed to provide our services, or as required to comply with legal obligations, resolve disputes, enforce agreements, protect the security and integrity of the Platform, and fulfill the purposes described in this Policy.
Even after you delete your account, we may retain certain information as required by law or for legitimate business purposes, including fraud prevention, safety, security, auditing, and legal compliance.
Transaction records may be retained for a minimum period required by applicable tax and financial regulations. Reviews and ratings may remain visible even after account deletion unless we determine removal is appropriate.
When personal information is no longer required for the purposes described in this Policy, we will delete, anonymize, or securely dispose of such information, unless a longer retention period is required or permitted by applicable law.
Retention periods may vary depending on the nature of the information, the services provided, applicable legal requirements, contractual obligations, the resolution of disputes, the prevention of fraud or abuse, and other legitimate business needs.
Where reasonably practicable, we apply data minimization principles by collecting and retaining only the personal information that is reasonably necessary to provide the Platform, comply with legal obligations, resolve disputes, enforce our agreements, prevent fraud, maintain security, and fulfill the purposes described in this Privacy Policy. We periodically review our data retention practices and securely delete, anonymize, or de-identify personal information when it is no longer required for these purposes, unless a longer retention period is required or permitted by applicable law.
8. Your Privacy Rights and Choices
Depending on your jurisdiction, you may have the following rights:

- Correction: Request correction of inaccurate or incomplete data
- Deletion: Request deletion of your personal data, subject to legal retention requirements and legitimate business purposes

- Withdraw Consent: Where we rely on your consent to process your personal information, you may withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of processing conducted before the withdrawal.
- Opt-Out of Targeted Advertising and Profiling: Where required by applicable law, you may have the right to opt out of targeted advertising, the sale or sharing of personal information, profiling in furtherance of decisions that produce legal or similarly significant effects, or certain automated decision-making activities.
- Appeal: Where provided by applicable law, you may have the right to appeal our decision regarding your privacy rights request.
- Non-Discrimination: We will not discriminate against you for exercising your privacy rights. We may require verification of your identity before processing requests. Note that certain rights may be limited where we have a legal basis to retain or process your data.
Before processing requests to access, correct, delete, or otherwise exercise privacy rights, we may request information sufficient to verify the identity and authority of the requesting individual. If we are unable to verify your identity, we may decline or limit our response as permitted by applicable law.
You may also designate an authorized agent to submit certain requests on your behalf where permitted by applicable law. We may require verification of both your identity and the authority of the authorized agent before processing such requests.
If you believe that our processing of your personal information violates applicable privacy laws, you may have the right to lodge a complaint with the applicable data protection or supervisory authority in your jurisdiction.
9. California Privacy Rights (CCPA/CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"), including the right to know about personal information collected, disclosed, shared, or sold; the right to access, correct, delete personal information; the right to opt-out of the sale or sharing of personal information; and the use of your personal information for targeted advertising or certain profiling activities, where applicable; the right to limit the use and disclosure of sensitive personal information where required by applicable law; and the right to non-discrimination for exercising your rights.
We do not sell your personal information for monetary consideration. However, we may share personal information with service providers, business partners, advertising partners, or other third parties as described in this Privacy Policy and as permitted by applicable law.

10. Cookies and Tracking Technologies
We use cookies, web beacons, pixel tags, scripts, and similar tracking technologies (including software development kits (SDKs), local storage technologies, and similar technologies) to collect information about how you use the Platform, to remember your preferences, to deliver personalized content and advertising, authenticate users, maintain security, and to analyze traffic and usage patterns. Some cookies are essential to the functioning of the Platform; others are optional.
You can manage cookie preferences through your browser settings. Disabling certain cookies may limit functionality of the Platform. Third-party analytics and advertising partners may also use cookies and tracking technologies on the Platform; their use is governed by their own privacy policies and applicable law.
We may participate in interest-based advertising. You may opt out of interest-based advertising through the Digital Advertising Alliance (DAA) or Network Advertising Initiative (NAI) opt- out tools.

11. Location Data
With your permission, we may collect precise geolocation data from your device to provide location-based services (such as matching you with nearby Contractors), verify service locations, improve search results, detect fraud, and enhance the functionality and security of the Platform. You can withdraw consent to location tracking at any time through your device settings.
We may also collect approximate location information derived from your IP address, Wi-Fi networks, Bluetooth signals, or other available technologies, where permitted by applicable law.
12. International Data Transfers
The Platform is operated from the United States. If you are accessing the Platform from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries that may have different data protection laws than your country of residence. By using the Platform, you consent to the transfer, storage, and processing of your information in these countries. We take steps to ensure appropriate safeguards are in place for such transfers in accordance with applicable law, including contractual safeguards, technical and organizational security measures, or other legally recognized transfer mechanisms where required.
13. Third-Party Services and Links
Our Platform may contain links to or integrations with third-party websites, services, or applications. This Privacy Policy applies only to our Platform. We are not responsible for the privacy practices of third-party services and encourage you to review their privacy policies before providing any information. Our display of or linking to any third-party service does not constitute an endorsement.
Third-party services that you choose to access or use through the Platform may collect, use, and disclose your information in accordance with their own privacy policies and terms of service. We encourage you to review those policies before using such services.
14. Children's Privacy
This Platform is not directed to or intended for use by individuals under the age of 18. We do not knowingly collect, use, or disclose personal information from anyone under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information promptly. If you believe we have inadvertently collected information from a minor, please contact us immediately at ChadAndrews@jobbidders.app.
If we learn that a parent or legal guardian has notified us that a child has provided personal information without appropriate authorization, we will take reasonable steps to investigate and delete such information, subject to applicable law.
15. SMS and Text Message Communications
By providing your phone number and using certain features, you may consent to receive SMS or text messages from us. Message and data rates may apply. You may opt out of SMS communications at any time by replying STOP to any message or by contacting us. We do not share your mobile phone number with third parties for their own marketing purposes.
We may use SMS or text messages to provide account verification, authentication, security alerts, transactional notifications, appointment reminders, customer support communications, and promotional messages, where permitted by applicable law and your communication preferences.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by posting the updated Policy on the Platform and updating the "Last updated" date. For significant changes, we may also provide notice via email or in-app notification.
YOUR CONTINUED USE OF THE PLATFORM AFTER THE EFFECTIVE DATE OF ANY CHANGES CONSTITUTES YOUR ACCEPTANCE OF THOSE CHANGES.
We encourage you to review this Policy periodically.
To the extent required by applicable law, we will obtain your consent before implementing material changes that require your consent.
17. AI Tools and Automated Processing
We may use artificial intelligence ("AI"), machine learning, and other automated technologies to improve the Platform and our services. These technologies may assist with customer support, service recommendations, contractor matching, fraud detection, identity verification, content moderation, analytics, workflow automation, and other operational functions.
Where we engage third-party AI service providers, such providers may process personal information solely for the purpose of providing services to us and in accordance with applicable contractual confidentiality and data protection obligations. We do not use AI to make solely automated decisions that produce legal or similarly significant effects on individuals unless permitted by applicable law.
We may provide AI-powered features such as AI-generated job descriptions, photo analysis, pricing guidance, bid writing assistance, content recommendations, and similar functionality.
To provide these features, we may transmit the information you submit, i ncluding job descriptions, photographs, project details, and other content you choose to provide, to trusted third-party AI service providers acting on our behalf. We require such providers to process personal information only for the purposes of providing the requested AI services and in accordance with applicable contractual confidentiality, security, and data protection obligations. We do not use your personal information to train publicly available artificial intelligence models unless expressly disclosed and permitted by applicable law.
AI-generated outputs may contain inaccuracies, omissions, or outdated information. Users should independently review AI-generated content and should not rely on it as a substitute for professional advice or independent judgment.
We may temporarily suspend or limit access to AI-powered features where we reasonably believe such features are being misused, including through automated abuse, excessive usage, fraud, prompt manipulation, spam, or other activity that threatens the integrity, security, or operation of the Platform.
18. Do Not Track Signals
Some web browsers include a "Do Not Track" feature that allows users to signal their privacy preferences. Because there is currently no universally accepted standard for responding to such signals, the Platform does not currently respond differently to browser-based "Do Not Track" requests. However, where required by applicable law, we treat universal opt-out preference signals, such as the Global Privacy Control ("GPC"), as a valid request to opt out of targeted advertising and the "sale" or "sharing" of personal information.
19. Social Login
If you choose to register or log in using a third-party authentication service (such as Google, Apple, Microsoft, Facebook, or similar providers), we may receive certain information from that provider, such as your name, email address, profile image, and other information that you authorize the provider to share. The information received depends on your privacy settings with the third-party provider.
If you sign in with Google, we receive information such as your name, email address, and profile picture from Google. If you sign in with Apple, we receive your name and email address; if you use Apple's "Hide My Email" feature, we receive a private relay email address instead of your personal email address. If you register directly with an email address and password, we collect and store your email address and a securely encrypted (hashed) version of your password. We never receive or store your password for any third-party login provider.
20. Users in the European Economic Area, United Kingdom, and Switzerland (GDPR)
This section applies to you if you are located in the European Economic Area ("EEA"), the United Kingdom, or Switzerland. For the purposes of the EU General Data Protection Regulation and the UK General Data Protection Regulation (together, the "GDPR"), the data controller of your personal information is JobBidders LLC, whose contact details are set out in the Contact Us section below.
We process your personal information only where we have a valid legal basis to do so, including: (a) performance of a contract where processing is necessary to provide the Platform and our services to you, such as creating and managing your account, facilitating bookings between Customers and Contractors, enabling communications, and processing payments; (b) legitimate interests where processing is necessary for our legitimate business interests, such as securing the Platform, preventing fraud, improving and developing our services, and performing analytics, provided that those interests are not overridden by your rights and freedoms; (c) consent, for example, for marketing communications, precise geolocation data, and non-essential cookies; you may withdraw your consent at any time; and (d) legal obligation where processing is necessary for us to comply with applicable laws, such as tax, accounting, and anti-fraud requirements.
In addition to the rights described in Section 8, if you are in the EEA, the UK, or Switzerland you have the right to: access and obtain a copy of your personal information; rectify inaccurate or incomplete information; request erasure of your personal information; restrict or object to our processing (including the absolute right to object at any time to processing for direct marketing purposes); receive your personal information in a structured, commonly used, machine-readable format and have it transmitted to another controller (data portability); withdraw your consent at any time without affecting the lawfulness of processing carried out before withdrawal; and not be subject to a decision based solely on automated processing, including profiling, that produces legal or similarly significant effects concerning you, except as permitted by applicable law.
You also have the right to lodge a complaint with the data protection supervisory authority in your country of residence, place of work, or the place of the alleged infringement. When we transfer your personal information outside the EEA, the UK, or Switzerland, we do so in accordance with Section 12 (International Data Transfers), relying on appropriate safeguards such as the European Commission's Standard Contractual Clauses or other legally recognized transfer mechanisms.
21. Biometric Information
JobBidders does not currently collect, store, or process biometric information. If biometric or identity verification features are implemented in the future, this Privacy Policy will be updated to describe those practices and any required notices or consents.
If identity verification features are implemented, our third-party identity verification providers may collect and process biometric information or biometric identifiers on our behalf, such as a scan of facial geometry derived from the photograph on your government-issued ID and a selfie submitted solely to verify your identity and help prevent fraud.
Where required by applicable law (including the Illinois Biometric Information Privacy Act and the biometric privacy laws of Texas, Washington, and other applicable jurisdictions), we or our identity verification providers will obtain any required consent before collecting biometric information; will not sell, lease, trade, or otherwise profit from biometric information; will retain biometric information only for as long as necessary to complete the verification process and as permitted by applicable law; and will permanently destroy biometric information once the verification purpose has been fulfilled or the applicable retention period has expired, whichever occurs first.
